Terms and Conditions
The Altruism website is owned and operated by Altruism Ireland, an organization granted charitable tax exemption by the Office of the Revenue Commissioners, Charities Section.
By using the Altruism website or registering with Altruism, you accept and are bound by the following terms and conditions.
Definitions used:
- "You/User" means any person using this website for any reason;
- "Website" means altruism.ie
1. Registration/Use
1.1 In using or registering with the Website, You represent that You are of legal age to form a binding contract and are not a person barred from receiving services under the laws of any applicable jurisdiction, or in the case of a company or other User that is not an individual You represent that You have the capacity to enter into a contract with Altruism.
1.2 You agree to provide and maintain true, accurate, current and complete information about yourself
1.3 Altruism may keep a record of User's registration details and details of any donations made by or to a User for the whole duration of the registration and for a period of 5 years thereafter.
1.4 Altruism is under no obligation to accept any individual as a Registered User, and may accept or reject any registration in its sole and complete discretion.
2. Charities
2.1 Registered charities in Ireland can join Altruism. We only include organisations to which the Office of the Revenue Commissioners, Charities Section have granted charitable tax exemption. In granting tax exemption Charities Section give the body a CHY reference number.
2.2 Altruism does not accept any liability for donations made by Users to organisations which have actually ceased to have official charitable status as decreed by the Revenue Commissioners.
2.3 Altruism shall not have any responsibility in connection with the activities of charities registered with this Website.
3. Fees and Payment
3.1 Altruism has agreed with each charity registered on this Website that there are zero charges for the user, with the exception of third-party bank fees that will automatically be deducted from every donation made using the Website. Third-party bank fees are currently 1.2% + 25c of the donation amount.
3.2 Your donation will be processed immediately by Altruism and the processing bank. You acknowledge that in the absence of fraud, you shall not have any right of cancellation of your donation and in placing a donation, you waive any statutory rights you may have to cancellation of the processing of your donation by Altruism.
4. Credit Card Payment
4.1 Users making donations by credit card hereby agree and assure Altruism that:
4.1.1 all charge card or credit card information supplied is true, correct and complete
4.1.2 the person making the donation is duly authorized to use the charge card or credit card for that purpose
4.1.3 the donation and the fees will be honored by the donor's credit card company.
4.2 If You discover that a donation has been made on this website site using Your charge card or credit card details in circumstances where You had not agreed to or authorised this, then (provided You have not, through failure to take reasonable care, allowed an unauthorised person to gain access to Your credit card details or password) Altruism is required to refund to You the money they receive provided that: (a) You inform Your credit card or charge card company and Altruism of the unauthorised payment as soon as You discover it; and (b) You co-operate with Your credit card company and Altruism and, if necessary, the police in relation to the unauthorised use.
4.3 All donations made via the Website are final unless fraudulent use of the card is proven in accordance with the previous paragraph.
5. Protecting Your password
5.1 It is up to each User to protect their username and password for their Altruism account. The User is responsible for all activities that occur under its password.
5.2 If you become aware of any unauthorised use of your password, we recommend that you change your password immediately.
6. Use of Your donation
6.1 Altruism takes no responsibility for Your dissatisfaction with the use of Your donation to any charity.
6.2 If You have cause for dissatisfaction with the use of Your donation You may contact the charity directly using the contact details provided on the Website.
7. Privacy and security policy
7.1 Altruism's Privacy Policy forms part of these Terms of Service. By agreeing to these Terms of Service you also give your consent to the way we may handle your personal information under that Policy. Read our Privacy Policy here.
8. User Conduct and Content
8.1 Users agree to act in a responsible and legal manner when using the Website. Users shall comply with all applicable laws, regulations and rules and undertake not to use the Website or allow the Website to be used for any unlawful purpose, for the commission of any offence or crime under the laws of any jurisdiction to which access is obtained through the website or in a manner which is likely to cause harm, offence or nuisance to any other Internet user.
8.2. the User agrees not to:
8.2.1 display on the Website, distribute from the Website or provide links from the Website to any pornographic, obscene, offensive, or menacing materials;
8.1.2 display on the Website or use in connection with the Website any pirated software or any copyrighted materials or counterfeit materials without the permission of the copyright holder;
8.2.3 use information obtained in connection with its registration with or use of the Website, or in any way use the Website, to carry out unsolicited mail-bombing or spamming or cause annoyance, inconvenience or anxiety to other Internet users;
8.2.4 use the Website or information obtained in connection with its registration to distribute or deliver any software virus or worms;
8.2.5 use the Website or information obtained in connection with its registration with or use of the Website to distribute, deliver or display any data, material or information which is defamatory, libellous or a hoax; or
8.2.6 display on the Website or use in connection with the Website any materials which in any way infringe the copyright, other intellectual property rights or proprietary rights of a third party or which may otherwise render Altruism liable to the payment of damages to any third party.
8.3 Altruism reserves the right to remove or suspend any material posted which is, in its sole opinion, in breach of this clause, or which it suspects to be in breach of this clause at its absolute discretion. Altruism shall be entitled to terminate a User's registration for breach of this clause.
8.4 It is Your responsibility to check with Altruism and the charity You wish to fundraise for regarding the suitability and appropriateness of Your chosen fundraising event. Users hereby acknowledge that dangerous events or events that are in poor taste may contravene the fundraising guidelines of the charity You have chosen to fundraise for or bring the charity into disrepute. Altruism reserves the right to cancel Your fundraising page should Altruism, in its sole discretion, or the charity for which You are fundraising in its sole discretion, deem Your fundraising event to be inappropriate.
9. Links
9.1 The Website may contain links to third-party websites (“External Sites”). These links are provided solely as a convenience to you and not as an endorsement by us of the content on such External Sites. The content of such External Sites is developed and provided by others. You should contact the site administrator or webmaster for those External Sites if you have any concerns regarding such links or any content located on such External Sites.
9.2 Altruism is not responsible for the content of any linked External Sites and do not make any representations regarding the content or accuracy of materials on such External Sites. You should take precautions when downloading files from all websites to protect your computer from viruses and other destructive programs. If you decide to access linked External Sites, you do so at your own risk.
10. Intellectual Property
10.1 The Altruism name and logo are the property of Altruism Ireland and may not be used in any way without express written permission from Altruism Ireland.
10.2 The website contains material, such as software, text, graphics, images, sound recordings, audiovisual works, and other material provided by or on behalf of Altruism Ireland (collectively referred to as the “Content”). The Content may be owned by us or by third parties. Unauthorized use of the Content may violate copyright, trademark, and other laws. You have no rights in or to the Content, and you will not use the Content except as permitted under this Agreement. No other use is permitted without prior written consent from us. You must retain all copyright and other proprietary notices contained in the original Content. You may not sell, transfer, assign, license, sublicense, or modify the Content or reproduce, display, publicly perform, make a derivative version of, distribute, or otherwise use the Content in any way for any public or commercial purpose. The use or posting of the Content on any other website, other than through the Third-Party Applications, or in a networked computer environment for any purpose is expressly prohibited.
10.3 With regard to content submitted by Users for their fundraising pages or otherwise ("User Content"), the user expressly acknowledge and agree that once you permit your User Content to be viewed by others, it will be accessible and viewable by them. The user retains all copyrights and other intellectual property rights in and to your own User Content. The user does, however, hereby grant us a non-exclusive, royalty-free, perpetual, transferable, sublicensable license to modify, compile, combine with other content and data, copy, record, synchronize, format, and index the User Content and display, perform, commercialize, and make it available to others in all media now known or hereafter devised, including, without limitation, through the website.
11. Changes to these terms and condition Termination
11.1 Altruism reserves the right at any time from time to time to modify, restrict, suspend, or terminate this Agreement and your access to all or any part of the website, at any time and for any reason without prior notice or liability.
11.2 Altruism reserves the right to change, suspend, or discontinue all or any part of the website at any time without prior notice or liability.
11.3 Every time You use the site You are deemed to have understood and accepted the latest terms and conditions as published at the time.
12. Limitation of Liability
12.1 Altruism makes no warranties or representations about the contents of the services, including, without limitation, the content (including, without limitation, any reviews, ratings, or financial data), or the user content. Altruism shall not be subject to liability for any delays or interruptions of the services from whatever cause. You agree that you use the content, the services, and the user content at your own risk.
12.2 Altruism does not warrant that the services will operate error-free or that the services, its servers, its content, or the user content are free of computer viruses or similar contamination or destructive features. If your use of the content, the user content, or the services results in the need for servicing or replacing equipment or data, Altruism shall not be responsible for those costs.
12.3 The content, the user content, and the services are provided on an “as is” and “as available” basis without any warranties of any kind. Altruism disclaims all warranties, including, but not limited to, the warranty of title, merchantability, non-infringement of third parties’ rights, and fitness for particular purpose.
12.4 In no event shall Altruism be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use, inability to use, disclosure, display, or maintenance of any content, user content, or the services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if Altruism have been advised of the possibility of such damages. When the law does not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, Altruism’s liability shall be limited to the greatest extent permitted by law.
12.5 The services may contain technical inaccuracies or typographical errors or omissions. Altruism is not responsible for any such typographical, technical, or other errors listed on the services. Altruism reserves the right to make changes, corrections, and/or improvements to the website at any time without notice.
13. Governing Law
13.1 These terms and conditions are governed by the Irish law and the Courts of Ireland shall have jurisdiction to determine any dispute arising in connection with them.
